Preamble

________ has decided to implement a teleworking plan in order to maintain workplace productivity and to protect employees. The policy describes the implementation of telework.

Telework means employees work outside of the company premises, such as working from home, through the use of technology.

Employees of ________ working from home have the same rights as those who carry out their assignments on the premises of ________, both individual rights (training, career management, remuneration) or collective rights (election of staff, representatives, trade union functions, collective benefits, employee savings, etc.).


I- Telework Accessibility

1- Eligible Telework Positions

Any employee of the company who meets the following conditions can work from home during the coronavirus pandemic:

________ will assist disabled employees' access to teleworking, provided that installing special equipment does not result in undue hardship for the company.

2- Implementation of Telework

a- Employee's Information

________ will provide employees with telework information in the following manners:

  • How to set up telework;
  • Rules concerning the use of the equipment made available by the company;
  • Procedures for monitoring working hours and workload;
  • Data protection and confidentiality rules;
  • Policy on hygiene and on health and safety at work and particularly the rules of precaution concerning the use of screens.

The employee applying for telework will attend training on how teleworking is practiced at ________.

3- Telework Facilitator

A telework facilitator is appointed to answer any questions employees may have about telework and to follow up on the implementation and execution of telework at ________.


II- Telework Process

1- Employer's Obligations

a- Equipment

________ provides the teleworking employee with all the necessary equipment to perform his/her tasks, including:

________.

________ covers the cost of provision, repair and replacement of the equipment provided. The employee shall sign a document containing a list of all the equipment provided. All equipment on the list shall be returned by the employee when teleworking is no longer required.

________ shall cover the cost of damage to property of any kind made available to the teleworker in the course of his/her professional activity, unless such damage is caused by the negligence or misconduct of the employee. ________ has a specific computer multi-risk insurance for this purpose.

b- Coverage of Costs Related to Teleworking

________ pays the employee an allowance based on the space the teleworker has chosen to work at home. The amount of the allowance is calculated on the basis of the rental value of the employee's home.

________ will cover the cost of telephone and internet subscriptions whose use is strictly for business purposes only.

The other expenses paid by the employee in the scope of teleworking will be reimbursed upon presentation of receipts according to the current rules at ________.

c- Privacy Policy

________ respects the privacy of the teleworking employee. ________ obtains the employee's agreement before going to the employee's home to install, replace or check the operation of the equipment.

________ shall not contact the employee outside of working hours.

2- Employee's Obligations

a- Employment Terms and Conditions

The employee shall not engage in personal activities during working hours. The employee devotes himself/herself exclusively to his/her professional duties. The employee shall perform his/her professional duties in a workable environment, as was done on the premises of ________.

Exceptionally, the employee may perform a family activity during working hours, such as the care of a minor child under 16 years old or subject to an isolation measure. The employee has to prove the closure of the facility where his/her child is usually accommodated and the impossibility of finding another solution for the care of his/her minor child under 16 years old.

b- Control of Working Hours/ Workload Regulation

The employee must work the number of hours specified in his/her contract. The working hours will be monitored as follows:

The workload that can be performed during normal working hours by the employee will be determined by his/her immediate superior. The completion of this workload within the time limit will be equivalent to compliance with the working hours set out in his/her employment contract.

c- Time Periods to Contact the Employee

The employee must be reachable at the following times:

Alternative times may be agreed with the employee's immediate superior.

d- Use of Equipment and Communication Tools

The equipment and communication tools provided by ________ are exclusively reserved for the performance of the duties related to the employee's employment contract. Personal use is prohibited and may give rise to disciplinary action according to the internal rules of ________.

The employee agrees to take maximum care of the equipment provided by ________ and to respect the good practices and instructions for use communicated by ________.

The employee shall immediately report any breakdown or malfunction of the equipment as well as any unavailability of the communication tools to the IT department of ________, which will take necessary measures to repair or replace the equipment as soon as possible. The employee shall discuss with his/her immediate superior the terms of continuing to work remotely or on-site for the duration of the breakdown or unavailability of the equipment or communication tools.

e- Data Protection

The employee agrees to comply with the rules established by the ________ concerning the confidentiality and protection of personal data the employee handles in the context of his/her duties.

f- Medical Leave

The employee who is subject to a medical leave of absence shall inform his/her superior within the same time limits and under the same conditions as employees working on the premises of ________.
