DOMESTIC WORK AGREEMENT


This Domestic Work Agreement (the "Agreement") is made and entered into this ________ day of _______________________, 20_______, the City/Municipality of _____________________, Province of _____________________, by and between:


________, Filipino, of legal age, and with address at ________, hereinafter referred to as the "Domestic Worker"

- and -

________, Filipino, of legal age, and with address at ________, hereinafter referred to as the "Employer"

The Domestic Worker and the Employer shall be referred to collectively as the "Parties".


The Domestic Worker and the Employer agree on the following:


I. TERM OF THE AGREEMENT

The Domestic Work Services will begin on ________.


II. LOCATION

The Domestic Worker shall perform the Domestic Work Services at the following location (the "Location"): ________.

The Domestic Worker shall stay within the premises of the Employer for the duration of the Agreement.

The Domestic Worker shall not perform work involving commercial, industrial, or agricultural activities.


III. PERFORMANCE OF WORK

1. Working Hours. The Domestic Worker shall perform their duties starting on: ________, and ending on: ________.

2. Rest Periods. The Domestic Worker shall rest outside the working hours as mentioned in the preceding paragraph. Further, the Domestic Worker shall have a weekly day-off on Sunday.

The Domestic Worker shall also be entitled to a rest day during holidays.

3. Tasks and Obligations. The Domestic Worker shall perform household work in the Location including but not limited to the following:

IV. WAGES

The Domestic Worker shall be paid a daily wage of ________ (₱________) (the "Wages").

If the Domestic Worker performs work beyond the working hours, the Domestic Worker shall be paid an additional hourly wage equivalent to ________ (₱________).


V. BENEFITS

The Domestic Worker shall be entitled to government-mandated benefits namely, PAG-IBIG, Social Security System Contributions, and PhilHealth. These benefits shall be deducted from the monthly wages of the Domestic Worker.

The Domestic Worker shall be entitled to five (5) days of yearly leaves (Service Incentive Leaves) which should be used by the Domestic Worker yearly. The employer shall extend assistance to the Domestic Worker in case the Domestic Worker requires medical assistance. In addition, the Domestic Worker shall also be entitled to the following benefit:

VI. PAYMENT

The Employer shall pay the Wages at every end of the week.

Further, the Wages shall be paid by depositing the amount in the following account:

VII. TERMINATION

If the Domestic Worker abandons work or leaves without justifiable reason, any Wages that are left unpaid not exceeding Wages worth fifteen (15) days of work shall be forfeited.


VIII. RESIGNATION

The Domestic Worker may resign from work after giving a notice of thirty (30) days before the effective date of resignation. The notice may be given orally or in writing.


IX. DEPLOYMENT

The Employer shall cover the deployment expenses incurred by the Domestic Worker which may include but are not limited to the travel expenses of the Domestic Worker from his home or place of origin to the Location of the place of work, and other expenses relative thereto.

XI. WRITTEN NOTICES

All notices that are required to be in writing and any other communication may be made through the phone number and/or email of the Parties as follows:

XII. APPLICABLE LAW

This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines.


XIII. ENTIRETY OF AGREEMENT

This Agreement represents the entire agreement between the Domestic Worker and the Employer and supersedes all prior negotiations, representations, and agreements, either oral or written.


XIV. AMENDMENTS AND MODIFICATIONS

This Agreement may be amended only by a written instrument signed and agreed upon by both Parties.
