Choose the type of employment that the employee will be engaged in.

Select "Regular employment" if the employee will be engaged as a regular employee.

Regular employees are those employed as permanent employees and can only be dismissed for just and authorized causes such as poor performance, misconduct, or redundancy.

Select "Probationary employment" if the employee will be engaged as a probationary employee.

Employees are usually hired on a probationary basis to allow the employer to evaluate the qualifications or capacity of the employee. The probationary employee must be given the standards upon which he shall be evaluated and said standards must be explained to him. The probationary employment cannot exceed 6 months. If the probationary employee passes his evaluation, he becomes a regular employee.

Select "Fixed period employment" if the employee will be engaged for a fixed period.

An employment with a fixed period means that the employment is for a fixed period of time that has been voluntarily agreed upon by the parties and is not designed to circumvent labor laws.

Select "Casual employment" if the employee will be engaged as a casual employee.

A casual employee is one doing work that is not usually necessary or desirable to the employer and is not a project, seasonal, or fixed-period employee. This is usually done for contractual employment and is merely incidental to the business of the employer, and the employee is not under the complete control of the employer. This also means that the employer's business can operate without the employment of a casual employee.

Select "Project employment" if the employee will be engaged as a project employee.

A employee is hired for a specific undertaking or project. His employment ends upon the completion of the project. The date of completion of the project must be determined at the time of engagement of the employee.

Select "Seasonal employment" if the employee will be engaged for a certain season. A seasonal employee is hired for a specific period or season of the year.

The EMPLOYER undertakes to ensure that the EMPLOYEE shall not work in any activity that subjects the EMPLOYEE to any form of exploitation or is harmful to the EMPLOYEE 's health and safety or physical, mental or psychosocial development.

COMPENSATION

The EMPLOYEE shall be paid a gross rate of ________ (₱________) per day, subject to government-mandated deductions to be borne by the employee, every 1st and 1st day of the month.

The EMPLOYER may, at its discretion, grant bonuses, allowances, or benefits not defined in this contract. Such exercise of discretion shall not be considered as established practice or precedent and shall not be demandable under this Employment Agreement or any other written or unwritten agreement.


III. THIRTEENTH MONTH PAY

The EMPLOYER will pay the mandatory Thirteenth (13th) month pay before 24 December of each calendar year.


IV. MANDATORY BENEFITS

Benefits that are mandated by law or the following document: ________, which has been provided to the EMPLOYEE at the signing of this AGREEMENT, shall be paid or provided by the EMPLOYER only when mandated and applicable to the EMPLOYEE, according to the law or the above-mentioned document.

XII.
CONFIDENTIALITY

The EMPLOYEE understands and acknowledges that all records, documents, and other information, written or otherwise, are confidential and shall not be disclosed during and after employment with the EMPLOYER.


XIII.
SEVERABILITY

The invalidity of any portion of this AGREEMENT will not and shall not be deemed to affect the validity of any other provision. In the event that any provision of this AGREEMENT is held to be invalid, the EMPLOYER and the EMPLOYEE agree that the remaining provisions shall be deemed to be in full force and effect as if they had been executed subsequent to the expungement of the invalid provision.


XIV.
ENTIRETY OF AGREEMENT

This AGREEMENT represents the entire agreement between the EMPLOYER and the EMPLOYEE and supersedes all prior negotiations, representations, agreements, either oral or written.
