Harassment Cease and Desist Letter

A Cease and Desist Letter is used as a formal request to the recipient to stop (cease) and not continue (desist) any unwelcome or illegal behavior. If the recipient fails to comply with the request, the sender should be prepared to take further legal action to stop the behavior that is harming or interfering with the sender's rights and well-being.

This Cease and Desist Letter is specifically drafted to address harassment in its general sense. Harassment may be in the form of causing psychological or financial distress, or any other act that is unwelcome or offensive in nature.

Harassment may include the unnecessary sending of excessive text messages, damaging someone's property, trespassing on someone's property, or any other irritating acts that are offensive in nature.

How to use this document

This document can be used by a person who is experiencing harassment by another. The letter will include the following information:

• The identification of the person who suffers and requests to cease and desist the harassment.
• The identification of the person who is requested to cease and resist the harassment.
• The details concerning psychological distress, financial problems, or any other harassing activities.
• The period of time within which the harassment should stop.
• A warning that a lawsuit will result if the harassment does not stop.

Once completed, the sender should print and sign the document. If there are any other documents to be attached, the sender may attach the same to this document. The letter can be sent by registered mail or by personal service.

Applicable law

There are no specific laws outlining what must be included in a Cease and Desist Letter. However, it is important to include a detailed description of the offending behavior and a clear demand to stop the behavior otherwise legal action may be taken. The Cease and Desist Letter can also be used as evidence that the recipient was put on notice about their offending behavior so the more detailed the letter, the better.

The Civil Code specifically in the provisions of Human Relations may be relevant, as well as the provisions of the Revised Penal Code in case the person causing the harassment does not stop the offending acts.
