This child support application letter can be used by a person who has been awarded child support or other assistance used for the maintenance of children. This letter can be used to remind the party owing support of their obligations. This document can be used to notify the party of the court order or child support agreement and serve as proof that a written reminder was given. By making a written request for child support that is due, a person can document the request in case of future litigation or dispute.

How do I use this document?

This document contains all the details necessary to demand child support or other maintenance for the children, including the names and contact information of both parties, the title and, if applicable, the case number of the court order requiring one of the parties to pay support, the amount of support that is expected to be paid and how often, and the amount of support that is due at the time the letter will be sent.

This letter also details the type of support that is to be paid.

  • Child support is a cash payment that is usually awarded by court order and is based on the income of the person paying the support.
  • A court may also order or the parties may agree to other types of support, including support awarded to one party to pay for a specific child-related expense, such as support to pay for children's health insurance premiums, camp, extracurricular activities, or private school tuition.

Once completed, this document can be signed and sent by registered mail so that there is an official record of the date the application was sent and received by the recipient.

Applicable Law

Child support is governed by both provincial/territorial and federal law. In determining child-related issues such as custody, access, and support, a court must approve any arrangement based on the "best interests of the child" test. Generally, if both parents reach an agreement on these issues, a court will be willing to include that agreement in the formal legal documents. However, there is always the possibility that a court will require a modification of the agreement if it determines that it is not in the best interests of the children involved.
