The Caregiver Agreement is used to hire an individual to provide help or take care of another person in exchange for compensation. This document is useful for persons who need more than the occasional help due to old age or a terrible illness. In such cases, either the client or the client's family decides to hire a caregiver to nurse and take care of the client.

The caregiver is the person providing help or care to the client, while the client is the person receiving the help. In some cases, a caregiver agreement may include a guardian who will hire the caregiver on behalf of the client.

Choosing the right caregiver is important because the client will depend on the caregiver to provide personal help.

For this reason, some families may hire another member of their family or a trusted person to care for their aged or ill family member.

The caregiver is heavily involved in the day-to-day activities of the client, which may typically include:

  • preparing meals for the client,
  • helping the client with their drugs,
  • running errands, and
  • taking the client for hospital visitations (if necessary).


However, the specific duties of the caregiver will depend on the client's special needs. For example, if the client is aged and not ill, the caregiver may not be required to take the client to hospital appointments. In other cases, if a client has memory loss and is incapable of managing their finances, the caregiver may handle the client's finances.

This document outlines the relationship between the client, the guardian (if required), and the caregiver. It specifies:

  • the duration of the contract,
  • the duties of the caregiver and the guardian,
  • the compensation structure, and
  • other general provisions such as confidentiality obligations.

Note that this document is not the same as the Service Agreement or Employment Agreement, as these documents are more general. However, this document is specifically used to hire persons to provide caregiving services.


How to use this document

The party using this document should enter relevant document relating to the contract. The document asks specific questions that should be answered with precision. Either the client receiving the care or the client's guardian may complete this document.

After completing this document, it should be printed and signed by the guardian and the caregiver if the guardian is hiring the caregiver on the client's behalf. However, if the client is hiring the caregiver, both the client and caregiver should sign the document.

Each party should keep one original copy of the signed document for their record.


Applicable law

There is currently no specific law regulating the provision of caregiving services in Nigeria. However, since the caregiver may be considered as an employee or service provider, the Labour Act applies to this document. Also, the rules of general contract apply to this contract.
