The Child Support Demand Letter is the letter used by a spouse/guardian who is demanding child support from the spouse responsible for child support as a result of a court order or as a result of an agreement entered into between the parties. This notice can be sent as a reminder to the other party to fulfil his/her obligations. This can also be used as proof of request in future litigation or dispute.


How to use this document?

This document includes all necessary details including party details, court order or agreement details, payment due date, total outstanding amount to be paid, last date for making the payment, communication details, etc.

The child support can be of the recurring payments at specific intervals or one-time settlements. Usually, child support is determined by the court of law concerned, considering the background of the supporting spouse and the requirements of the children. If the party fails to obey the court order, the spouse/guardian taking care of the child can send this letter as a warning before approaching the same court to execute its order. If the due is under an agreement entered into between the parties, this notice can be used as a warning letter before approaching the appropriate court to execute the agreement.

Once the letter has been filled, the sender can send it through a registered post with acknowledgement due or to the email address of the recipient. It is better to keep the record of acknowledgement of receipt by the recipient for any future reference and legal proceedings.

Child support is generally covered under section 125 of the Code of Criminal Procedure, 1973 (CrPc) and relevant sections of the personal laws applicable in India.
