The notice demanding spouse support is the notice used by a spouse who is entitled to get alimony from the other spouse as a result of a court order or as a result of an agreement entered into between the spouses. This notice can be sent as a reminder to the other party to fulfil his/her obligations. This can also be used as proof of request in future litigation or dispute.

In India under the Hindu Marriage Act, 1955, both the spouses are entitled to claim alimony and the court will decide upon the matter by considering multiple factors in accordance with law and precedence.

 

How to use this document?

This document includes all necessary details including party details, court order or agreement details, payment due date, total outstanding amount to be paid, last date for making the payment, communication details, etc.

The alimony can be of the recurring payments at specific intervals or one-time settlements. Usually, the alimony amount is determined by the concerned court of law. If the party fails to obey the court order, the spouse entitled to get alimony can send this notice as a warning before approaching the same court to execute its order. If the due is under an agreement entered into between the spouses, this notice can be used as a warning letter before approaching the appropriate court to execute the agreement.

Once the letter has been filled, the sender can send it through a registered post with acknowledgement due or to the email address of the recipient. It is better to keep the record of acknowledgement of receipt by the recipient for any future reference and legal proceedings.

 

Applicable law

The payment of alimony will be covered under the respective personal laws applicable to the parties involved in the separation. Violation of contract will be dealt with under the Indian Contract Act, 1872.
