This Internship Agreement is a contract used when hiring an intern. It can be used for diverse types of entities like companies, LLPs, partnerships, etc. in any kind of industry including Information Technology, manufacturing, marketing, hospitality, etc.

This Agreement can be used for interns currently studying in some institute or has completed their studies and intends to do an internship.

This Agreement sets out all the terms of the internship, including duties of the intern, stipend and benefits, work hours, confidentiality, intellectual property rights and various other key terms.

In many cases, once an employer chooses to hire a new intern, the parties want to get started without delay. Therefore, the employer may wish to provide the intern with a letter that briefly spells out some key terms. Employers may wish to use an Offer Letter for an Internship in these situations and then follow it up with this Internship Agreement.

However, this Internship Agreement goes into more detail about the various terms of the internship and provides a more robust document so that both the employer and the intern fully understand what is expected of one another, and how the internship arrangement may develop over time.

This Internship Agreement is not suitable for an employment relationship. For that purpose, an Employment Agreement can be used. Employment refers to a paid job on a long-term basis. An Internship, on the other hand, is a temporary position that is designed to give a student or recent graduate hand on experience in a particular field or industry.

In comparison to employment, internships are often unpaid or low-paid, and they may last anywhere from a few weeks to a few months. Internships are often seen as a way for people to gain experience and build their resumes, while employment is a more established and permanent position.


How to use this document?

This Agreement covers the following major areas:

- Stipend to be paid to the Intern;

- Schedule and overtime rules. This includes whether the Intern is allowed to work with flexible hours or not and the check-in and check-out rules of the organization;

- Whether to work remotely or in the office;

- Obligations of the Intern while working remotely;

- Resources provided to intern;

- Performance reviews and reporting of duties;

- Confidential information and data security guidelines and rules; and

- Intellectual property rights.

The Internship Agreement should be printed on non-judicial stamp paper and then both the employer and the intern will need to sign the document and keep a copy for their own records.

This Agreement can also be notarized by a public notary (optional) for more authenticity and recording of the date and time of the execution of the Agreement. If not notarized, two witness signatures at the end can also help in validating the document in the future.

 

Applicable Law

The internship may be subject to the general terms of the Indian Contract Act, 1872.
