The primary purpose of this letter is to make a formal written request to the employer to sanction the annual leave from work for a specific period. Sometimes, the annual leave may be sanctioned over verbal communication with the employer, but it is always better to put the request in writing (even if verbal approval has already been provided) to avoid any disputes in the future.

This letter can be used by any type of employee working in different types of organizations/companies. This document can be used in case of an initial request or following up on verbal communication with the employer. In India, except for factories under Factories Act 1948, we don't have any uniform labour laws on annual paid leave. It is dependent on the Shops and Establishment Acts of each state. For example, in the state of Delhi, the employee is entitled to an annual paid leave of 15 days and in Kerala, it is 12 days.

This letter covers different scenarios in which annual leave is requested, including whether the employee has already taken annual leave or not, requesting leave that is not otherwise permitted under the company's policy, the delegation of works/duties during the period of vacation and so on.

This letter is specifically created for requesting annual leave. If the need for applying for general leave, a Letter Requesting Leave can be used.

 

How to use this document?

This letter can be used even if the employee has received verbal permission from the employer. Using this letter will help the employee to put the request and other details on record for any further reference.

This letter clearly mentions the details such as the number of annual leave required, start date and end date of annual leave, the reason for taking the annual leave, delegation, or assignment of pending tasks and duties to someone in the organization, contact details of the employee during the annual leave period and so on.

This letter can be printed, signed, and directly handed over to the organization or sent through a registered post. It can also be sent as an email attachment.

 

Applicable law

The Labour Law in India is generally covered under the Shops and Establishments Act of the concerned states and Factories Act, 1948. However, each company may have specific internal policies regarding the annual leave in addition to the state laws.
