The Letter Requesting Return/Replace a Product ("Letter") is sent to the seller to either replace the product with a good product or return and refund the amount paid for the product. This letter can be sent to the seller as a first step in getting the matter resolved. If the seller is not responding or neglecting the request under this letter, the purchaser can send a Notice before filing a consumer complaint.

 

How to use this document?

Details such as products, consideration paid, details about the defects in goods, the period for rectification of the error in the product, etc. can be mentioned under this Letter.

The sender can specifically mention the losses/damages incurred by them due to the defects in the product and can specifically ask for payment of damages within the stipulated period.

Through this Letter, the sender can ask for the remedies like removing the defects in the product, replacing the product with a new product, refunding the amount paid for the product, and paying the expenses/losses incurred by the sender due to defects in the product.

The following person(s) can send this letter:

  • Consumer – In case of goods – a consumer means any person who buys any goods for consideration and includes any user of such goods other than the person who buys such goods for a consideration, when such use is made with the approval of such person but does not include a person who obtains such goods for resale or for any commercial purpose.
  • Legal Representative of the Consumer – A duly appointed legal representative of the consumer. A representation is possible based on a respective Power of Attorney duly signed by the Consumer.
  • Legal Heir of the Consumer - Legal heir/s of the deceased consumer.
  • Parent/Guardian of the Consumer - In the case of minors, their parents or guardians can send this letter to the erring seller.
  • Voluntary Consumer Organization - such an organization has to be registered under the Companies Act.
  • Group of Consumers - one or more consumers having the same interest can send this letter together.

This letter will act as a first step in communicating with the seller to resolve the defects in the product or refund the amount without resorting to any legal warning or action. If the seller is not complying with this letter, the purchaser can send a final notice before filing a consumer complaint and taking other legal action against the seller.

The legal proceeding under the Consumer Protection Act, 2019 has to be initiated within 2 years from the cause of action.

 

Applicable law

The laws under the Consumer Protection Act, 2019 will be applicable here. If the issues have not been resolved within the stipulated period mentioned under the Letter, the sender can send a final notice before filing a consumer complaint.
