A Letter of Application for Probate is a document used to apply for the grant of probate to the will of a deceased person. This application should be made by the executor to the will, either in person or through their legal practitioner.
An executor is a person who is given the responsibility of carrying out the instructions in a Will or Codicil. The executor is a personal representative of the deceased and is responsible for overseeing the proper administration of the deceased properties.
If a person dies testate, the executors are required to apply for probate at the high court within the deceased's last place of residence.
The applicant should state the name of the deceased; the full name of the deceased's spouse and children (if any); the deceased's gender, date of death and place of death; and the fact that the deceased resided within the jurisdiction the application was made.
How to use the document
Once this document is completed, it should be printed and signed by the applicant. After that, one copy of this letter should be submitted to the appropriated probate registry and keep one copy for record purposes. The probate registrar or an officer at the probate registry will thereafter deliver a set of probate forms to the applicant to be filled out and submitted to the probate registry.
