A Leave Request from Employee is a letter request by the employee asking the employer for a grant of a leave of absence due to certain personal reasons.
The reasons the employee could have for claiming a leave may be to take the time to recover from an illness or injury, to have a vacation, or to attend to any other personal matters. A grant of leave may be subject to the discretion of the employer and may be denied if the needs of the employer's business require the presence of the employee or if the reasons for the leave are not acceptable to the employer.
The Labor Code grants a regular employee who has rendered at least one year of service the right to ask for leave for a total of 5 days with full pay. This is called the Service Incentive Leave to which the employee is entitled. The employee can make use of his service incentive leaves continuously or in parts, i.e., one day for this month, and four days for another month, and may be used as sick leave or vacation leave if such type of leaves are not granted under the company policy or the employee's employment contract.
If the type of leave is provided by the employer's company policy or the employee's employment contract, this may also be availed of by the employee as the need arises. Thus, if the employer's company policy grants sick or vacation leave for a certain number of days and the employee needs to use the same, the employee may use this letter to request a grant of the leave. In case of doubt, the employee should ask the employer whether there are certain kinds of leave that the employee may avail of.
This document should not be used for special types of leaves such as maternity leave, paternity leave, solo-parent leave, and the leave provided by the magna carta of women as these special leaves require certain conditions under the law for them to be granted by the employer.
How to use this document
The details of the employee such as the employee's name and contact details should be provided, as well as the details of the employer to whom the leave is requested by the employee, and the date of commencement of the leave, and the date when it ends.
The details to be provided may vary depending on the type of leave that the employee is requesting.
Sick Leave: If the employee is asking for sick leave and has already obtained a medical certificate concerning the illness or injury the employee currently has, the medical certificate should be attached to this letter before sending it to the employer.
Vacation Leave: The reasons for asking the vacation leave may be included.
Service Incentive Leave: The number of days which the employee may ask for leave is 5 days for every year. And it will be optional to provide the reason for claiming or applying the same. This type of leave can also be used as a sick or vacation leave in the absence of such leaves under the company policy or employment contract.
If the employment contract or the employer's company policy provides a certain kind of leave, this may also be applied for by the employee as well as the reason for claiming or applying for the same.
After completing the document, this letter may be printed, signed, and sent to the employer and the employee should keep a copy for their records. This letter may likewise be sent via email to the employer.
