Fill out the templateThis document can be used by a window cleaning business in England or Wales. The document is a simple contractual document which sets out the terms and conditions applicable to window cleaning services. The document is designed for use where the services will be provided to individual consumers*. The document can be used by an individual window cleaner who conducts their business on their own, or a larger window cleaning business. These terms and conditions can be used where the services will be sold online or in person.
A consumer is an individual who purchases goods and/or services for personal use. Consumers have certain rights and protections. We have a commercial services agreement available for use where one business is providing services to another business.
It can be helpful for a window cleaning business to have an agreement to confirm the terms and conditions applicable to their services because:
Where a services agreement is concluded away from the business premises/trading address of the window cleaner (at a distance), certain information must be provided to a consumer. The window cleaning business will want to make sure that the pre-sale information provided on its website (or in any other form) complies with such requirements. Distance contracts for more than £42 will also have a 14-day cooling-off period (cancellation right). If the services are to be commended within 14 days of the agreement commencing, the consumer's explicit consent should be obtained.
A window cleaner will need to consider what other policy documents they may need to hold and other requirements they may need to meet in addition to this agreement. For example, this might include:
The document should be completed with all the relevant information about the window cleaning business and its services.
If the window cleaning business concludes bookings for the services with the consumer on a face-to-face basis (for example in the consumer's home), the window cleaning business can retain a signed copy of the terms and conditions to provide to customers. If a customer wishes to book the services, a copy of the terms and conditions should be provided to them together with the quote for the services. The consumer should be requested to sign a copy of the terms and conditions and the quote, to signify their agreement.
If the window cleaner concludes bookings online (e.g. via a website/email), the terms and conditions can be placed on the website of the window cleaning business and can also be emailed to consumers with the quote for the services. The consumer will accept the quote for the services (and the terms and conditions) by following the relevant approach of the business (i.e. by clicking a button or sending an email). The business should make it clear that, in accepting the quote, the consumer is accepting the terms and conditions.
The agreement will then start upon the consumer's receipt of a booking confirmation from the window cleaning business.
The general principles of contract law will apply to this agreement.
The customer will be protected as a consumer under:
The window cleaner will need to check all relevant regulatory requirements and health and safety regulations.
