A Bartending Agreement is a document used by two parties where an individual bartender or company that provides bartenders agrees to render bartending services to a client. This Agreement allows the bartender and the client to outline the scope of their relationship and describe the specifics of the bartending services that will be provided. This document can be used both by clients who wish to hire a bartender or bartending company as well as a bartender or bartending company who intends to provide those services to a client.

Often, individuals enter into business relationships without having all of the details of the parties' relationship with each other written down. By discussing the specifics of the Agreement ahead of time, both the service provider and the client can make sure that their needs and wishes about the business relationship are known and respected. This document is specifically for services related to someone providing bartending services. This website also has a general purpose service agreement that can be used for someone providing a different kind of services.

How to use this document

This document covers all of the important information necessary for a bartender or bartending company to enter into a business relationship with a client including the following details:

  • Pertinent identifying details for both parties involved
  • Specifics of the services that will be provided
  • Responsibilities of the Bartender and Client, including knowledge of federal, state, and local alcohol laws and provision of tools necessary to render the bartending services
  • Amount of compensation the bartender will receive, include late fees, over time, and retainer fees or deposits as applicable
  • Details about when and how the Agreement will be terminated
  • Adherence to confidentiality and warranty provisions guaranteeing the quality of the work

The bartender and the client can discuss the terms of the Agreement and create and sign the final Agreement together prior to the work actually beginning. This Agreement can also be created after the work has already begun for the purpose of clarifying the relationship between and the responsibilities of all of the involved parties. After inputting the required information, the Agreement is printed out and signed by both Parties, and then kept on file by both Parties for the duration of the Agreement as well as for a reasonable period of time thereafter.

Applicable law

All Service Agreements are subject to both federal and state laws that cover general contract principles governing how contracts are created and interpreted by courts. Federal laws may restrict what services can be contracted for (for example, illegal services may not be contracted for) and certain broad categories, like contracting for something that looks more like an employment relationship, but individual state laws may govern the interpretation of the contract in case of a dispute. This Agreement also includes a section guaranteeing that the bartender will follow any and all applicable federal, state, and local laws related to alcohol, including refraining from serving minors or in locations such as state parks where alcohol may be prohibited by law.
