A Creative Artist-Agent Agreement is a document used by two parties where an individual agent or a company that provides agents agrees to represent an artist by marketing and representing the business interests of the artist. The agent uses their skills and expertise to secure assignments, bookings, and sales through promoting the artist's work. The artist provides the agent with samples, such as headshots, demo reels, lookbooks, or portfolios of their work which assist the agent in marketing their work.

Hiring an agent can be beneficial to an artist, as the agent has connections and knowledge available to them that can help the artist reach a larger market. For example, actors trying to book acting roles, visual artists looking to get their art placed in galleries, and writers trying to get a book published could all benefit from working with an agent. Once the agent secures a booking for the artist, they can also negotiate details of the deal, such as the writing of a Production Agreement or a Music Recording Contract.

By using this Agreement, the artist and agent are able to detail their expectations for each other, describe the scope of their business relationship, and outline the specific services that will be provided. This document can be used both by artists who wish to hire an agent or company that provides representation services as well as an agent or company who intends to provide those services to an artist.

Often, individuals enter into business relationships without having all of the details of the parties' relationship with each other written down. By discussing the specifics of the Agreement ahead of time, both the service provider and the client can make sure that their needs and wishes about the business relationship are known and honored. This document is specifically for services related to someone acting as an agent for an artist. This website also has a General Purpose Service Agreement that can be used for someone providing a different kind of service.

How to use this document

This document covers all of the important information necessary for an agent or company that provides marketing and representation services to enter into a business relationship with an artist who needs assistance booking assignments and making sales, including the following details:

  • Pertinent identifying information for all involved parties
  • Specifics of the services provided, including the type(s) of promotion and marketing that will take place
  • Amount of compensation the agent will receive, including commission, salary, hourly rates, late fees, retainers, and compensation for promotion and marketing expenditures as applicable
  • Details about when and how the Agreement will be terminated
  • Adherence to confidentiality provisions guaranteeing the artist's privacy

The agent and the artist can discuss the terms of the Agreement and create and sign the final Agreement prior to the work actually beginning. This Agreement can also be created after the work has already begun for the purpose of clarifying and formalizing the relationship between the parties and describing the responsibilities of all involved parties. After inputting the required information, this Agreement is printed out and signed by both Parties, and then kept on file by both parties for the duration of the Agreement as well as for a reasonable period of time thereafter.

Applicable law

All Service Agreements are subject to both federal and state laws that cover general contract principles governing how contracts are created and interpreted by courts. Federal laws may restrict what services can be contracted for (for example, illegal services may not be contracted for) and certain broad categories, like contracting for something that looks more like an employment relationship, but individual state laws may govern the interpretation of the contract in case of a dispute.
