Artistic Production Agreement

An artistic production agreement is a specific type of service agreement in which one entity, the production service provider (or producer), undertakes to produce an artistic or media project for the client. Production agreements can be between large entities, such as two large companies, or between individuals (in other words, a small client hiring a small producer).

The purpose of the agreement is to document the producer's involvement, the project they will undertake, to whom production services will be rendered, the payment structure, the agreement's duration, and more.

More specifically, the agreement covers the project that both parties will be working on, such as film, music or any other media production. The agreement also contains provisions more commercially required, such as:

• the manner and timing of payment;
• the project deadline;
• the production budget; and
• liability clauses.

The agreement also contains a clause allowing for royalty payments to the producer.

HOW TO USE THIS DOCUMENT

In this document, basic information is listed, such as the names and identifying details of the parties. From there, however, the agreement becomes more robust and all relevant contract details are listed, such as project details, fee structure, project specifications (if applicable), specific clauses regarding marketing and royalties, and termination information. The fee for example can either be a fixed, flat-rate or based on a weekly, monthly or annual plan, depending on how the parties decide to arrange the fee structure.

Once completed, the contract should be printed and signed by both parties. Each party must then keep a signed copy for their records.

APPLICABLE LAW

In Canada, production agreements are generally subject to the laws of each province and territory and follow the general rules of commercial contracts.
