This Influencer Agreement is a contract by which a party is contracted to market or promote the products or services of a particular brand through social media. The influencer is a party who, through their numerous followers, are able to influence the purchase decision of their many followers.

For example, a social media influencer must be one who has many followers, such as tens of thousands or millions of followers. Due to the large followership, a brand can use the influencer's platform to promote or sell their products or services.

With the growth of social media, digital marketing has become the new form of advertisement. This document outlines the terms and conditions of the social media marketing, including the amounts of posts the influencer is required to make at a particular time, the number of platforms on which the contents can be posted, the brand regulations or instruction with which the influencer is expected to comply, the influencers remuneration, and the duration of the contract.


How to use this document

This document should be completed by entering all the required information. After completing the document, it should be printed and signed by the parties to the agreement.

If the advertiser is a company, the common seal of the company should be affixed on the document and either two directors or one director and one company secretary should sign the document. If the advertiser is any other organization other than a company, for example, a business name (sole proprietorship or partnership), incorporated trustee, etc. an officer of the organization (for example, the sole proprietor, a partner, trustee, etc.) should sign the document.

After signing the document, the parties should keep at least one copy of the signed document for their record.


Applicable laws

There is no specific law that regulates social media marketing or promotion. However, the Advertising and Practitioners (Registration, Etc.) Act No. 55 of 1988, CAP A7, Laws of the Federation 2004 provides the statutory framework for the regulation of advertisers in Nigeria. Also, the general rules of contract apply to the document.
