A Notice of Intent to Vacate is a letter used by a tenant to let their landlord know that they do not plan to renew the lease at the end of the lease term and will be vacating the premises. This letter can be used by both residential and commercial tenants. By using this letter to provide their landlord with appropriate notice, the tenant can ensure a harmonious and smooth transition out of the lease and can increase their chances of getting their security deposit returned.

This letter should be used by a tenant who wishes to leave a rental property at the end of their lease. If a tenant would like to leave the property before their lease is due to terminate, a Termination of Tenancy Letter should be used. For a landlord who wishes to evict a tenant, the Eviction Notice should be used instead.

How to use this document

This Notice includes information such as the location of the rental property, the date the lease started, and the date the tenant plans to move out. This Notice also allows the tenant to document the number of days notice they are giving the landlord before moving out, allowing them to conform to the requirements of the Lease. Most leases include requirements around the amount of notice a tenant must provide before vacating. Finally, this Notice includes the option for the tenant to provide their forwarding address to help insure that their landlord has the correct address to mail their security deposit and can return the deposit in a timely fashion.

Once this notice is completed with all of the relevant information, the tenant can save a copy for their records and send an original signed copy to the landlord by certified mail. Using certified mail allows them to have a record that written notice was sent in case of any future dispute.

Applicable law

Matters related to lease agreements are generally subject to the law of individual states. Different states have different requirements about the amount of notice a tenant must provide before declining to renew a lease and moving out. However, nearly all states require that some form of written notice be given to the landlord prior to vacating the premises.
