This letter can be used by a consumer to make a claim against a credit card company for a refund for a purchase made on their credit card. The letter may be used where the purchase was made from a company outside of the United Kingdom, provided that the consumer lives in the United Kingdom. This type of claim is commonly called a section 75 claim.

This letter can be used where the purchase of a single product or service was more than £100 but not more than £30,000. It is also possible to use this letter where part-payment was made on the credit card, even if this was £100 or less, provided that the total value of the single product or service was more than £100.

If the consumer can establish a claim of breach of contract or misrepresentation* against the seller, the credit card company will be liable for this. If the consumer does not achieve a satisfactory solution directly from the seller*, they can therefore make a claim against the credit card company. The sender may wish to attach evidence to their claim such as:

  • receipts, invoices or email confirmation relating to the purchase
  • any relevant adverts about the purchase
  • a link or copy to the relevant terms and conditions (particularly if there has been a direct breach of those conditions)
  • copies of any correspondence with the seller about the issue
  • photo evidence to show the issues

This letter should not be used if the purchase was made on a debit card as different rules apply where that is the case. We are currently in the process of creating a letter for this.

A breach of a contract will include a breach of any specific terms and conditions but will also include any failure of a trader to meet the standards required under consumer laws.

In the first instance, a consumer may have made attempts to resolve the matter with the seller by sending them a letter or formal notice that they have breached the agreement.

How to use this document

This document should be completed with all the relevant information.

The sender should check the process for submitting a s75 claim with the credit card company. The company may have a specific process for this. The letter can be signed electronically or it can be printed, signed and posted.
