An Affidavit of Birth is a document submitted to a Court, University, or other institution in order to verify or correct birth information. A person might need to verify their birth information to apply to school or a job or to get a passport, visa, or other government documents. Common situations where an individual might use an Affidavit of Birth include:

  • A birth record that has been misplaced or destroyed
  • An incorrect or incomplete birth record
  • Supplementary proof of birth information submitted along with a birth certificate

Once an Affidavit has been completed, it can be used as a convenient alternative to an official birth certificate.


How to use this document

This document should be completed by a person, known as the Affiant, who can attest under oath to their personal knowledge of the circumstances surrounding the subject's birth. This person could be a relative, like a parent or a grandparent, or someone who was present at the birth, like a physician or close family friend. The document includes information identifying the Affiant, including their name, address, and birth date. The document then goes on to list information identifying the subject of the Affidavit, like their name, gender, age, and citizenship. Finally, the document explains how the Affiant and the subject know each other and the source of the Affiant's personal knowledge about the circumstances surrounding the subject's birth.

Once the Affiant completes the Affidavit, they should sign it and have it notarized. The subject of the Affidavit should keep the notarized Affidavit in a safe place, such as safety deposit box, so that it is always available to use when they need proof of their birth.


Applicable law

There are no laws outlining exactly what must be put into an Affidavit of Birth. There are, however, some generally accepted practices for creating such documents, including making sure the information is robust enough to be persuasive to an authority that the Affiant is qualified to attest to the circumstances surrounding subject's birth.
