A Copywriting Agreement is a document between two parties, the copywriter and the client, for copywriting services. Copywriting is the job of drafting words, or copy, for anything from websites to posters to emails. Many businesses, including those solely for information services on the internet, often require copywriting work. Copywriters can draft everything from a business card up to a full brochure and everything in between. In fact, many copywriters, especially those that work primarily with online copy, have their own freelance careers and therefore would require an agreement like this for each of their clients.

In this Copywriting Agreement, the parties agree to the terms of the relationship between them, including such items as what exactly the copy projects are and whether the copy will be used for a limited purpose or any purpose, among other things.

In an agreement like this, standard contractual clauses are also included, such as choice of law and venue.

This document is different and more specific than a Service Agreement, as it is specifically designed to include clauses relevant to copywriting work between two parties. This document is also different than a Graphic Design Agreement, as there, the services being contracted for are design, instead of writing. Additionally, please be advised that a Copyright Assignment, though it sounds similar, is a completely separate document designed to transfer ownership of a copyright (like a work of art) to a new party.

This document can be used in any scenario in which a client would like to hire a copywriter. It can be used by either party - in other words, for a copywriter looking for a standard template for clients, this would be a good fit. The size and structure of the copy project or projects doesn't matter, this agreement can be used for all types of copywriting works.

In this document, basic identifying information about the parties will be entered, such as names and address details. Then, details about the copy work, such as what the works are, deadlines, pricing information, etc., will be included.

After this document is filled out, it is should be printed so that both parties can sign it. Then, a best practice is for both parties to keep a copy.

 

Applicable law

Copywriting Agreements are normally subject to individual state laws, governing general and commercial contract principles. Depending on what the specific copy is, such as whether it's online, the agreement could also be subject to rules under the Federal Trade Commission.
