A Cease and Desist Letter is a letter that is sent to an individual or organization to discontinue or cease from engaging in an illegal or offensive activity. This letter is often used as a first step to asking a party (either an individual or organization) to refrain and desist from doing an offensive/illegal activity.

This offensive activities/behaviours include: harassment, defamation, slander or libel, breach of contract, copyright infringement, mismanagement of funds, insider trading, etc.

In this document, the form filler will be required to include the following information:

  • The name and address of the sender of the letter.
  • The name and address of he recipient of the letter.
  • A detailed description of the offensive behaviour.
  • The negative effects this offensive behaviour has on the sender.

The letter also contains a stern warning that a lawsuit might ensue if the offensive activity persists and a deadline by which the offensive activity must stop or else further legal action will be instituted against the recipient.


How to use this document

This letter is used for general purpose to stop any offensive or illegal activity or behaviour.

After filling this form, the sender should sign the document and deliver it to the individual or organization engaged in the offensive activity. If the sender is an organization, an authorized representative of the sender organization should sign the document on its behalf. The sender is also required to keep a copy of this letter for record purposes.

If the recipient does not stop the offensive activity, the sender can institute a legal action in court against the recipient.


Applicable law

There are no laws outlining the content of a Cease and Desist Letter. However, the sender is required to provide clear description of the offensive activities and the demand they are making as this document may be used as evidence in court to show that the recipient was adequately notified of their behaviour/activities and properly cautioned against it.
