An Employee Privacy Policy is a document that describes the data employers collect, how they store their employee's data and the measures they put in place to ensure the security of their data. It tells the employees how their data will be processed.

This document outlines the various forms of personal data that are collected by employers from their employees. When an employee is hired, certain personal and sensitive information are collected from the employee. Therefore, it is important to have policies in place to ensure the protection of these information.

Personal information or data is any information that identifies the employee, which includes the employee's contact details, date of birth, marital status, gender, account details. However, sensitive information is information about an employee's criminal record, religious or political beliefs and ideology, medical record, and certificate, and so on.

Although the employer is permitted by law to collect this information regarding their employees for the processing of their employment and use during their employment, the employer is required to put measures in place to ensure the security of the information collected. Consequently, this document allows the employer to state how they intend to protect or safeguard their employee's data.

How to use this document

In this document, the employer will be able to outline the categories of data they collect from their employees, the purpose of collecting these data, how the data is used and stored, the rights of employees regarding their data, and how their employees can make complaints regarding data breaches (if any). Also, if the data can be shared with related entities and third parties, the document outlines how the employees' data are protected from a data breach.

Employers often require the personal data of their employees, therefore, this document should be used anytime an employer hires a new employee. It is usually issued to an employee along with an Offer of Employment and Employment Agreement.

Also, some employees include their employees' privacy policy in the Employee Handbook, while others prefer to have them in a separate document.


Applicable laws

The Constitution of the Federal Republic of Nigeria,1999 guarantees the privacy rights of every Nigerian citizen. Although Nigeria is yet to have any robust law on personal data protection, the National Data Protection Regulation, 2019, which was issued by the National Information Technology Development Agency is applicable to this document.
