Fill out the templateA Landlord can use this Notice of Change of Rent to notify a Tenant or multiple Tenants who reside in a rental property that the rate of rent will either be increased or decreased. The benefit of using his document is that the change of rent is documented in writing so as to prevent misunderstanding or future disputes over the amount of rent due. In addition, this notice should only be used where there is a written Tenancy Agreement, as this notice ensures the Landlord is in compliance with the conditions surrounding the rent review process and helps avoid a situation where the Tenant(s) claim that the rent change is illegitimate.
This notice should be used where the residential property is in the jurisdiction of England and Wales.
How to use this document
This Notice allows the Landlord to lay out the specifics of rent collection, including the original rent amount, the new rent amount, and the frequency with which the Tenant(s) will be required to pay rent. The Landlord can also make note of when the Tenant(s) will be required to start paying the new rent amount. The Landlord can also choose to state the reason for the increase or decrease of the rent amount and provide contact information to the Tenant(s) in case they have any questions or concerns about the new rent amount. The length of the notice of change of rent given by the Landlord should always be in line with the minimum periods permitted by law depending on the frequency of rent payment.
Once this Notice has been filled out, the Landlord should send a copy to all Tenants concerned via post. By sending the notice through post, the Landlord will have a record of when and where the Notice was received by the Tenant(s). This information could prove useful in the event that there is a future dispute. The Landlord should also retain a copy of the Notice for their own records. Upon the change of the rent, the Landlord and Tenant can either:
Note: Under UK law, the Landlord must give the Tenant(s) at least 1 month's notice before rent can be increased where rent is paid at weekly or monthly intervals, while the Landlord must give the Tenant(s) at least 6 months' notice before rent can be increased where rent is paid annually. Additionally, where the tenancy is for a fixed term, the rent can only be increased if the tenant agrees to the increase. On the other hand, where the tenancy is a periodic tenancy (that is, a rolling tenancy renewed every week or month), the rent cannot be increased more than once a year without the tenant's consent.
As such, this notice should be used where the Landlord and Tenant have already reached an agreement on the change of rent, and the Landlord uses this notice to serve as written evidence/record of the change of rent.
