Parking Space Rental Agreement (Scotland)

This document can be used to rent a parking space within private property in Scotland. It creates a contract of lease between the owner of the property and person who shall rent the parking space.

The document can be used where the owner is either a company, a firm or an individual, and where either an individual, a company, a firm or a group of individuals is renting out the parking space for their own use. Moreover, the document can be modified to account for a large number of different scenarios including where parking spaces are allocated and/or specified, where multiple vehicles may use the space, and where the parking space may only be used during certain times.

This document takes into account a number of typical issues which may arise in parking space rental agreements such as responsibility for any damage incurred alongside responsibilities for matters such as keeping the parking space clear and tidy or storage of petrol.

How this document should be used

This document should be carefully read by all parties. Then, each party should sign and return a copy, and once signed, every party should be given a copy. Please note that if the document is being signed on behalf of a company, it should be signed twice; either by two directors, or by a director and company secretary, unless the company is a one-person company.

On the date set out in the agreement as the start date, the person(s)/organisation renting the parking space may then start to use it in accordance with the agreement, and any schedule set out within it.

The agreement will last until ended by the parties giving notice. In order to end the agreement, either party can serve notice to the others in accordance with the agreement, and the agreement will then end after the notice period set out within the agreement.

Applicable Law

A Parking Space Rental Agreement is a common law contract governed by the principle of contract law. Users may also wish to consider Unfair Contract Terms Act 1977, Unfair Terms in Consumer Contracts Regulations 1999, and the Consumer Protection From Unfair Trading Regulations 2008 when setting their own terms, particularly if the contract is entered into as the owner's primary business activity.
